California Personal Injury Attorney Cites Negligence in Suit Against Toyota
Stan Casper, of Casper, Meadows, Schwartz & Cook, prepares for court battle in case of woman left paralyzed following runaway Toyota accident.
May 16, 2010 /24-7PressRelease/ -- On February 25, Stan Casper, a personal injury lawyer and partner at the Bay Area law firm of Casper, Meadows, Schwartz & Cook, filed a lawsuit against Toyota on behalf of Sohn and Kyu Fong. In 2008, Sohn M. Fong was driving the family's 2004 Toyota Camry when she experienced sudden acceleration and an inability to stop the car. The car left the road and crashed, rendering her paraplegic. Her husband, Kyu H. Fong, suffered severe abrasions and other injuries.
"This is an example of a car accident that just shouldn't have happened," said Casper. "We believe that Toyota knew about acceleration problems in the Camry going all the way back to the model year 2002 and covered them up or, at least, ignored them. Responsible people, using their vehicles in a responsible manner, deserve more than Toyota seemed willing to give them."
In their lawsuit, the Fongs accuse Toyota and its employees of negligence, strict liability, misrepresentation and other offenses leading to the crash and Sohn M. Fong's subsequent injuries. The Fongs are seeking damages related to product liability, breach of express and implied warranties, and overall negligence.
Due to the severity of her injuries, Mrs. Fong continues to require 24/7 attendant care. "The Fong family is the human face of Toyota's problems with unintended accelerations," said Casper. "These are people whose lives have been irreversibly altered."
To date, the Toyota recall includes nearly nine million vehicles, including Camry models from 2007 to 2010.
